Terms of Service
1. PARTIES
This User Agreement ("Agreement") has been drawn up between [Kutoba Software Services] ("Platform" or "KutQR") on one side and the real or legal person ("User") who is a member of the Platform on the other side, for the purpose of the User becoming a member of the Platform and utilizing its services.
2. SCOPE OF THE SERVICE
KutQR provides a QR (Quick Response) code-based content management system (SaaS) infrastructure for its Users to publish product, price, and menu content in digital media. The Platform only provides the technical infrastructure (hosting) and is not a content producer.
3. RIGHTS AND OBLIGATIONS OF THE USER
- The User is exclusively responsible for all kinds of text, photos, price information, and content they upload to the Platform.
- The User accepts and undertakes that they own the copyrights of the content they upload, that they do not violate the personal rights of third parties, and that they do not host content contrary to the laws of the Republic of Turkey.
- The security of the user account (password, etc.) is entirely the responsibility of the User.
4. RIGHTS AND OBLIGATIONS OF THE PLATFORM
- Hosting Provider Status: The Platform has the status of "Hosting Provider" in accordance with Law No. 5651. It is not obliged to control the content created by Users.
- Continuity of Service: The Platform cannot be held responsible for interruptions caused by technical malfunctions or maintenance work.
5. INTELLECTUAL PROPERTY RIGHTS
The Platform's software, design, and source codes belong to KutQR. The rights to the content uploaded by the User belong to the User.
6. TERMINATION OF THE AGREEMENT
The User can cancel their membership at any time. The Platform has the right to unilaterally terminate membership in case of violation of the rules.
7. RESOLUTION OF DISPUTES
In case of disputes arising from this Agreement, [BALIKESİR] Courts are authorized.
Privacy Policy
This Clarification Text has been prepared by [Kutoba Software Services] as the data controller in accordance with the Law on the Protection of Personal Data No. 6698 ("KVKK").
1. Data Controller
Your personal data is processed within [Kutoba Software Services] ([Altıeylül BALIKESİR]).
2. Your Processed Personal Data
- Identity and Contact: Name, Surname, Email, Phone.
- Transaction Security: IP address, access logs, password information.
3. Purposes of Processing
Membership transactions, service delivery, fulfillment of legal obligations (Law No. 5651).
4. Data Transfer
Your data is not shared with third parties except for legal obligations. It can be transferred to authorized institutions upon request of official authorities.
5. Your Rights
In accordance with Article 11 of the KVKK;
- Right to know whether your data is processed,
- Right to request correction if processed incorrectly,
- Right to request deletion or destruction.
